Welcome to www.danielwellington.com (hereinafter the “Site”). These terms of use and sale (hereinafter the “Terms”) govern your purchases and browsing activities on this Site and form a contract between you and Daniel Wellington Taiwan (hereinafter “Daniel Wellington”) and its authorized distributor in Taiwan, Dragonfly Asia-Pacific Limited, Taiwan Branch (hereinafter the “Taiwan Branch”). Please make sure that you read and understand these Terms before using this Site and completing a purchase.

WHO IS ELIGIBLE TO PLACE AN ORDER?

This Site is addressed to individual consumers who are of the legal age of majority in their country.

CONFIRMATION

Once we have received your order we will send an electronic invoice to your e-mail address as a confirmation of your purchase. It is important that you enter the correct e-mail address when placing your order. We recommend saving this email in order to facilitate any contact with customer service you may have in the future. The order confirmation (receipt) also serves as guarantee of proof of purchase.

PAYMENT

You may pay by credit card or debit card. All payment transactions on this Site are processed by the third-party payment service provider ECPay using high-level encryption technology to ensure payment security.

As the payment service is provided by a third party, Daniel Wellington will not be held liable for any delays or failures caused by system errors or other circumstances not attributable to us. We do not store any credit card information; your payment details are sent directly to the bank for processing.

Once payment has been successfully completed, your order will be considered confirmed. For orders in Taiwan, electronic invoices will be issued in compliance with the Taiwan Uniform Invoice Act and sent via email to the address you provided. Please ensure the email address is correct.

PAYMENT BY CARD

We accept Visa and MasterCard. Payments are processed securely by ECPay using strict banking standards. Your card details are transmitted directly to the issuing bank and cannot be accessed by any third party. Orders may be automatically cancelled if payment is not received.

PROMO CODES

Promo Codes should be entered during the checkout process to be valid. Attempting to add a promo code after purchase will not be honored.

TAXES

All prices shown on this Site include applicable sales taxes.

ORDERING

Orders made in another person's name without the person’s consent, will be reported to the authorities.

RETURNS

Please refer to our Returns Policy.

As required by Article 19 of the Taiwan Consumer Protection Act, consumers in Taiwan are entitled to an unconditional right of return within 7 calendar days from the day after receipt of the product (earrings excluded).

WARRANTY

Warranty term: Two years from the date of purchase. This warranty covers manufacturing defects on the watch itself (movement, case, crystal). Other parts than the above are not covered by this warranty. To have replacement covered under this warranty performed, please use our contact form on the "contact us" page. In the e-mail you need to specify your name, address, order number and a detailed description of the issue. Finally, write ‘reclaim of purchase’ as subject of the e-mail or letter. Return shipping is paid by Daniel Wellington. If Daniel Wellington cannot find any defects described above, the product will be sent back to the customer.

Note that repair/replacements will be charged in the following cases, even during the warranty term. - Failure or damage caused by improper use or carelessness (knocks, dents, crushing, broken crystal, etc.) - Failure or damage caused by unjustifiable repair or modification - Failure or damage caused by fire or water, or a natural disaster such as for example an earthquake - Esthetical changes that occur during normal wear and tear and aging (minor scratches, etc.; on the case and/or crystal, alteration of the colour on the wristband and the peeling of the plating) - In case the retail store and the purchase date are not indicated on the warranty, or if this information has been rewritten - If the warranty is not submitted along with the watch. - Battery replacement will be charged even during the warranty term.

The case, dial, hands, crystal, watchband or other parts thereof may be replaced with substitutes if the originals are not available.

This warranty warrants that you can receive free replacement in accordance with the terms set forth herein and within the specified term, and shall not restrict any lawful right of the Customer.

When shopping with Daniel Wellington we will save some of your data to fulfill your purchase. Daniel Wellington treats all personal information confidential. You have the right to request access to your data and if there is anything wrong you can get it changed or removed. Daniel Wellington may also use cookies, for example in order to improve your experience of the website. PRODUCT

Daniel Wellington has the right to adjust prices, add additional cost, change product assortment and related information with respect to products offered for sale on this website, without notice. Product images and information texts made available by Daniel Wellington is to reflect the products as much as possible. While we try to ensure that all content on this website are accurate, errors may occur. Daniel Wellington cannot guarantee that all product images accurately reflect the true appearance of the products, all product images should be seen as illustrations. The product images may differ depending on the color settings on your computer.

DELIVERY AND CANCELLATIONS

Deliveries in Taiwan are handled by Black Cat Delivery Service (Yamato Transport). Taiwan orders will be fulfilled and after-sales service provided by the Taiwan Branch.

If you wish to cancel an order that has not yet been shipped, please contact our customer service to confirm the cancellation. We reserve the right to cancel your order and issue a full refund if the product has been discontinued and will notify you if alternatives are available.

COMPLAINTS TERMS

Please inspect your order immediately upon receipt. If the product is damaged, incorrect, or defective, you must contact our customer service within 7 days (including holidays) from receipt, and provide the order number and details of the issue.

Returned items must be properly packaged to prevent damage during transport. If the returned product is found to be free of defects, it will be returned to you.

LIABILITY

To the extent permitted by applicable laws and without prejudice to any statutory consumer rights: (a) Daniel Wellington's responsibility for errors in connection to delivery is limited to existing conditions of sale. (b) Daniel Wellington bears no direct or indirect responsibility for incompatibility, delivery delays, website downtime, or data loss.

FORCE MAJEURE

Daniel Wellington shall be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered or delayed by circumstances beyond our control. As the release factor should be considered include government intervention, new / amended legislation, lack of state, war, fire, flood, labor disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions or lack of delivery from suppliers and the company is exposed to criminal activity that affects activities.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, such as trademarks and copyright, on the website and in the material published on it are owned by Daniel Wellington or its subsidiaries or licensors. Any use of the site or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Daniel Wellington.

USER CONTENT

The www.danielwellington.com website may include user generated content from for example social media applications. Daniel Wellington does not claim any ownership in rights in such content (images, photos and videos etc.) and takes no legal responsibility for it. In case you suspect a violation of copyright, or any other right, or otherwise is offended by such content, please contact our customer service.

RETENTION OF TITLE

All title in products remain with Daniel Wellington until full payment is made.

FRAUD

All frauds are reported to the authorities and Daniel Wellington reserves the right to cancel the purchase if any suspicion is raised.

GOVERNING LAW AND JURISDICTION

These terms and your use of the www.danielwellington.com website are governed by the laws of Malaysia. To the extent permitted by law, the courts of Malaysia shall have exclusive jurisdiction of any dispute arising from these terms of use and sale and your purchase from and use of the website, subject to Daniel Wellington’s right to prosecute a user at his/her place of residence.

TERMINATION

Daniel Wellington reserves the right to terminate your account and/or your use of the www.danielwellington.com website with reason in its sole discretion. For example, if Daniel Wellington suspects that you have breached this terms of use and sale. Such termination can be made without prior notice.

AMENDMENTS

Daniel Wellington may revise these terms of use and sale from time to time. Every time you order a product from us, the terms of use and sale in force at that time will apply to the contract between you and Daniel Wellington. You should therefore periodically visit this page to review the then current terms to which you are bound.
